TERMS PROTOCOL ARCHIVE: CONDITIONS

# Terms of sale and license

What you buy, how you can use it, what I guarantee

These conditions apply to buying the Survival Apps Android apps (BioRadar, EcoSurvivor, HotSummer, Item90) from the Payhip checkout. They are written to be read, not to hide anything. If something isn't clear, write to me before buying.

## Who sells

Benedetto Durante — Survival Apps. Contact for anything: [contatti@survival-apps.com](mailto:contatti@survival-apps.com). The purchase contract is concluded with Survival Apps. Payment goes through the Payhip checkout, by card or PayPal.

## What you buy

An Android app as an APK file, downloadable right after payment, plus the license key that activates it. Each app's page describes its features and limits: they count as the description of the product. One-time payment, no subscription. The price includes VAT where applicable, as shown at checkout.

**Requirements:** an Android 7.0 or later phone. The APK installs outside Google Play: Android will ask for permission to install from unknown sources, once. Before installing you can check the file's SHA-256 fingerprint, listed on the app's page and in the [verification guide](https://survival-apps.com/en/transmissions/021-verify-apk-before-installing/).

## The license

- **PERSONAL** — the license is for personal, non-commercial use and cannot be transferred to others
- **3 ACTIVATIONS** — each key activates on up to 3 installations: they are for reinstalls and phone changes, not for sharing the app. If you run out, write to me: [I'll restore them](https://survival-apps.com/en/refunds/)
- **NO EXPIRY** — you pay once and the license has no end date
- **NO COPIES** — the APK and key may not be resold, redistributed or modified

## Online license check

At activation, and then about every 7 days when you're online, the app contacts Payhip to check that the key is valid. Without a connection the app keeps working. The license is deactivated in case of a refund or a payment dispute: at the next check the app locks. Which data is sent is explained in the [Privacy Policy](https://survival-apps.com/en/privacy/).

## Withdrawal, refunds and guarantee

You can withdraw within 14 days of purchase, without a reason and even if you have already used the app; I refund the full price. The legal guarantee of conformity for digital content applies in any case. All the details, including how to send the request, are in [**Refunds and withdrawal**](https://survival-apps.com/en/refunds/).

## Updates

Apps can change over time: I fix bugs and, when needed, adjust features and content. When an update is necessary for the app to keep working as described, I make it available to buyers at no cost.

## What the apps are not

My apps are tools, not advisors. BioRadar lists species observed by other people in your area: it does not identify from photos and doesn't replace an expert, especially for edible mushrooms and plants. HotSummer estimates heat risk from public weather data: it is not medical advice or an official alert. EcoSurvivor is a log with educational content: it is not financial, tax or legal advice. Item90 is a personal reminder of your supplies: it is not safety advice. Each app shows its disclaimer at first launch and you can re-read it any time.

## Liability

To the extent permitted by law I am not liable for indirect damages or for the loss of data saved on your phone (make the copies you need). Nothing in these terms limits the rights the law gives you as a consumer, nor liability for wilful misconduct or gross negligence.

## Third-party content

The apps use third-party services and data, each under its own license: iNaturalist and Wikipedia (BioRadar), Open-Meteo and OpenStreetMap (HotSummer, BioRadar). OpenStreetMap data is © OpenStreetMap contributors, ODbL license. The open source libraries included remain under their own licenses.

## Governing law

Italian law applies, without prejudice to the mandatory consumer protection rules of the country where you live. For any problem, write to me first at [contatti@survival-apps.com](mailto:contatti@survival-apps.com): it almost always gets solved that way.

Few rules, written clearly: it's the only way to trust a product you can't touch.
